NOTARY PUBLIC COMPLAINT PROCESS
"Please consider the following:
- A notary public commissioned in American Samoa that has been found violating any notarial laws will be subject to disciplinary action at the discretion of the Secretary of American Samoa.
- Complaints regarding the performance of an American Samoa notary public's duties should be submitted to the Office of the Secretary and must allege a violation of the American Samoa Code Annotated § 31.03.
- Complainants need to present factual evidence, within the complainant’s personal knowledge, that the notary engaged in conduct that violates the laws and rules in accordance with Title 31.
- If you wish to cancel, void, or modify a contract or document, or if you are seeking a refund, damages, or penalties, please consult an attorney for assistance.
- The Office of the Secretary of American Samoa cannot represent individuals filing complaints in any administrative, civil, or criminal proceedings, nor can it offer legal advice on such issues. Actions taken by the Office regarding administrative proceedings generally do not affect your civil or criminal rights.
- Any allegations of fraud or criminal behavior, such as forgery or elder abuse, should be reported to local law enforcement or the Attorney General's Office.
